As required by the Government Information (Public Access) Act 2009 (GIPAA) (see s39), Port Authority of New South Wales maintains a Contracts Register. This register includes details of contractual engagements with third parties where the contract value exceeds $150,000.
Under section 39 of GIPAA, some contracts may be excluded, as Port Authority is a State-Owned Corporation. Exceptions may apply if the contract relates to activities where the corporation or its subsidiaries compete in a market with other entities.
The following classes of contracts are excluded under section 39:
- Leases and licences where Port Authority is the landlord/owner, as these relate to competitive market activities.]
- Information technology contracts, due to cyber security risks.
- Licences for property with radar, navigation, or communication equipment, due to marine safety considerations.
